These terms govern your use of Wavelength, the tool that turns spoken or transcribed processes into editable flow diagrams.

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Wavelength, including our website, web application, and any related services (collectively, the "Service"), which is operated by Wavelength ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

2. The Service

Wavelength converts spoken or transcribed descriptions of processes into interactive, editable visual flow diagrams using AI. The Service allows you to generate, edit, version, export, and share process maps. We may modify, suspend, or discontinue any part of the Service at any time, and we may update these Terms accordingly.

You may need to create an account to use certain features. You agree to provide accurate, current, and complete information, to keep your credentials secure, and to be responsible for all activity under your account. You must be at least the age of majority in your jurisdiction to create an account.

You retain ownership of the transcripts, prompts, and diagrams you submit ("Content"). You grant us a limited license to process your Content solely to provide the Service to you. We do not use your Content to train, fine-tune, or evaluate any machine learning model, and we do not share it with third parties except the processing providers required to deliver the Service, listed in our Privacy Policy. You are solely responsible for the Content you submit and for ensuring you have all necessary rights to do so.

We collect and process certain data about your use of the Service, including through Google Analytics, which associates usage and visitation information with your interactions on our site and app property.

6. End-User Data & Google Analytics Consent

By using the Service, you confirm that you have the necessary privacy disclosures and rights from your end users for the collection and processing of their data, including the association of such data with the visitation information Google Analytics collects from your site and/or app property. You are responsible for providing appropriate notice and obtaining any required consent from your end users, and for complying with applicable privacy laws, including where those laws require disclosure of Google Analytics data collection and the option to opt out.

7. Subscriptions & Billing

Paid plans are billed on a recurring basis through our payment processor, Stripe. Subscription fees are charged in advance and are non-refundable except as required by law. You may cancel a subscription at any time; cancellation takes effect at the end of the current billing period. We may change pricing upon reasonable notice.

8. AI Output

Diagrams and other output generated by the Service's AI are produced by automated models and may be incomplete, inaccurate, or misleading. You are responsible for reviewing and verifying all output before relying on or sharing it. We do not guarantee any specific accuracy or suitability of AI-generated content.

9. Intellectual Property

The Service, including its design, software, branding, and features, is owned by us and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, trade names, or other identifying marks except as expressly permitted.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law, we and our affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or business, arising out of or related to your use of the Service, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your Content, your use of the Service, or your violation of these Terms or third-party rights.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ends, though these Terms remain in effect as to past use.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted with an updated "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
